1. Agreement to these Terms

These Terms of Use ("Terms") govern your use of Mul, a personal travel diary application made by German Amaya ("German Amaya," "we," "us," or "our"). By downloading, accessing, or using Mul, you agree to these Terms and the Mul Privacy Policy. If you do not agree, do not use Mul.

2. Eligibility

Mul is intended for a general audience and is not directed to children under 13. You may use Mul only if you can legally enter into this agreement. If you are under the age of majority where you live, you may use Mul only with permission from a parent or legal guardian.

3. Permission to use Mul

Subject to these Terms and the applicable App Store license, German Amaya grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable right to use Mul on Apple-branded devices that you own or control, solely for your personal, non-commercial travel-diary use.

Except as permitted by applicable law or the applicable license, you may not copy, modify, distribute, sell, lease, reverse engineer, decompile, disassemble, attempt to derive source code from, or create derivative works of Mul or any part of it.

4. Your travel diary content

You retain any rights you have in the travel entries, notes, dates, tags, and photos you choose to associate with Mul (collectively, "Your Content"). You are responsible for Your Content, including ensuring that you have the right to use any text, place information, or photo you choose to associate with an entry.

Mul is a private diary tool. It does not publish Your Content to other Mul users or operate a public social feed. You authorize Mul to process Your Content on your device and, when you enable iCloud synchronization, through Apple services solely to provide the app’s features at your direction.

You must not use Mul in a way that violates applicable law, infringes another person’s rights, introduces malware, interferes with the app or Apple services, or attempts to gain unauthorized access to any account, device, network, or data.

5. Apple services, iCloud, and photos

Mul may use Apple services including iCloud, CloudKit, Photos, iCloud Photos, the App Store, and StoreKit. Your use of those services is subject to Apple’s applicable terms, account requirements, service availability, and privacy practices.

When iCloud synchronization is enabled and available, eligible Mul data may synchronize through the private CloudKit database associated with your Apple Account. Synchronization depends on factors outside German Amaya’s control, including your Apple Account status, iCloud settings, network connectivity, device storage, Apple service availability, and the state of your devices.

Mul stores references to photos you choose rather than duplicate copies of the original image files. A photo reference may not resolve on another device if the original photo is unavailable through Apple Photos or iCloud Photos. You are responsible for preserving any originals or backups that matter to you.

6. Subscriptions, free trials, and purchases

Mul may offer free trials, auto-renewable subscriptions, or other in-app purchases through the App Store. The purchase screen and Apple’s purchase confirmation present the applicable product, price, duration, trial or offer terms, and renewal information before you complete a transaction.

• Billing: Apple charges purchases to your Apple Account after you confirm the transaction.
• Automatic renewal: An auto-renewable subscription continues to renew for successive periods unless you cancel it before the current period ends. The applicable price and renewal period are those shown in the purchase flow and your Apple Account subscription settings.
• Free trials and offers: A trial or introductory offer, when available, converts to the paid subscription described in the purchase flow unless you cancel before the offer period ends.
• Management and cancellation: You can manage or cancel a subscription in your Apple Account subscription settings. Deleting Mul does not cancel a subscription.
• Restore purchases: Use Mul’s Restore Purchases function, where available, after signing in with the Apple Account used for the purchase.
• Refunds: Apple handles billing and refund requests under its applicable policies. German Amaya does not process payment-card refunds directly.

Availability, pricing, taxes, currency, and eligibility may vary by storefront and can change in accordance with Apple’s rules and applicable law. We do not guarantee that every plan, trial, or offer will be available in every region or at every time.

7. Ownership and intellectual property

Mul, including its software, design, branding, graphics, text, and other materials provided by German Amaya, is protected by applicable intellectual-property laws. Except for the limited right to use Mul expressly granted in these Terms and the applicable Apple license, German Amaya and its licensors retain all rights, title, and interest in Mul.

"Mul" and related branding are trademarks or trade names of German Amaya. Apple, App Store, iCloud, CloudKit, Photos, iCloud Photos, and StoreKit are trademarks or service marks of Apple Inc. Apple is not affiliated with or responsible for Mul except as required under the applicable App Store terms.

8. Updates, availability, and changes

We may update, modify, suspend, or discontinue all or part of Mul to maintain security, improve features, meet legal requirements, or respond to changes in Apple services. We will not intentionally use an update to remove a paid entitlement in violation of applicable law or the App Store terms.

Mul and related Apple services may be unavailable, delayed, or limited from time to time. We do not guarantee uninterrupted or error-free operation, continuous synchronization, or perpetual availability of any feature.

9. Disclaimers

Mul is provided on an “as is” and “as available” basis, to the maximum extent permitted by law. German Amaya disclaims warranties that are not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and uninterrupted availability.

Mul is a personal organization tool. It does not provide travel, immigration, visa, medical, legal, safety, booking, navigation, or emergency advice. You are responsible for independently verifying travel requirements, reservations, routes, local conditions, and any information important to your decisions.

Nothing in these Terms excludes or limits a warranty, remedy, or consumer right that cannot lawfully be excluded or limited.

10. Limitation of liability

To the maximum extent permitted by law, German Amaya will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, travel opportunities, or business interruption arising from or related to Mul, even if advised of the possibility of such damages.

To the maximum extent permitted by law, German Amaya’s total liability for claims arising from or related to Mul will not exceed the greater of (a) the amounts you paid to German Amaya through the App Store for Mul during the 12 months before the event giving rise to the claim, or (b) US$100. This limit does not apply where applicable law prohibits it.

11. Responsibility for misuse

To the extent permitted by law, you will defend, indemnify, and hold harmless German Amaya and its personnel from claims, damages, liabilities, and expenses arising from Your Content, your misuse of Mul, or your violation of these Terms or applicable law.

12. Apple-specific terms

German Amaya, not Apple, is responsible for providing Mul support and for addressing claims relating to Mul or your possession or use of Mul, including product-liability claims, claims that Mul fails to conform to applicable legal or regulatory requirements, and claims arising under consumer-protection or similar laws.

In the event of a third-party claim that Mul or your possession and use of Mul infringes that party’s intellectual-property rights, German Amaya, not Apple, will be responsible for investigating, defending, settling, and discharging the claim to the extent required by the applicable Apple license and law.

You must comply with applicable third-party terms when using Mul, including Apple’s terms for iCloud, Photos, and the App Store. You represent that you are not located in a country subject to a U.S. government embargo or designated by the U.S. government as a terrorist-supporting country, and that you are not listed on a U.S. government list of prohibited or restricted parties.

13. Termination

You may stop using Mul at any time. These Terms remain in effect until terminated. We may suspend or terminate access to Mul if you materially violate these Terms, misuse the app, create security risk, or if required by law. Sections that by their nature should survive termination will survive, including sections concerning ownership, disclaimers, limitations of liability, and Apple-specific terms.

14. Governing law and consumer rights

These Terms are governed by the laws that apply to German Amaya’s operation of Mul, without regard to conflict-of-law rules, except where the law of your country of residence requires otherwise. Nothing in these Terms limits rights or remedies you have under mandatory consumer-protection law.

15. Changes to these Terms

We may update these Terms when Mul, Apple services, legal requirements, or our business practices change. We will post the revised Terms here and update the “Last updated” date. Where required by law, we will provide additional notice or seek your consent before a material change takes effect.
